Right of Withdrawal — Costa Living

1. Scope of application

Under Royal Legislative Decree 1/2007 (General Law for the Defence of Consumers and Users, TRLGDCU), consumers have the right to withdraw from contracts concluded at a distance or away from business premises within 14 calendar days, without giving any reason.

This right applies to service contracts that may be concluded at a distance through this website (for example, commissioning a study or a preliminary design). It generally does not apply to construction or works contracts negotiated and signed in person, nor to construction services carried out to the customer's own specifications (see Section 5).

2. Withdrawal period

The withdrawal period is 14 calendar days from the conclusion of the contract (for services) or from receipt of the goods (for products, if any). If the last day of the period falls on a non-working day, it will be extended to the next working day.

3. Exercising the right of withdrawal

To exercise the right of withdrawal, the user must notify their decision by means of an unequivocal statement, using one of the following channels:

5. Exceptions to the right of withdrawal

Under Article 103 TRLGDCU, the right of withdrawal does not apply, among other cases, to the following — particularly relevant for a bespoke construction business:

The supply of goods or the execution of works made to the consumer's specifications or clearly personalised (for example, a villa project designed specifically for a particular plot).
Services that have already been fully performed, where performance began with the consumer's prior express consent and acknowledgement that they would lose their right of withdrawal once the contract had been fully performed.

The specific application of these exceptions to each type of contract (for example, a preliminary design contract versus a construction contract) should be assessed case by case with legal advice.

6. Effects of withdrawal

In the event of a valid and timely withdrawal, amounts paid — including ordinary delivery costs, if any — will be refunded within a maximum of 14 calendar days from the date the withdrawal decision is communicated, using the same means of payment used by the consumer, unless the consumer expressly agrees to a different method.
